Domestic Violence
If you are in an abusive relationship, we can act quickly to protect you and your children from the abuser. It is important to be safe first before taking any further steps.
What is Considered Domestic Abuse/Violence?
Domestic abuse occurs when someone close to you, your partner or spouse for example, causes you physical, sexual, emotional or financial hardship. Abuse is not categorised merely by physical violence alone.
Domestic violence and abuse can take on many forms. Sometimes the threat of physical violence is prevalent in a relationship, you may feel intimidated by your partner and treated poorly. Controlling behaviour, such as governing who you see and when, is also a form of domestic abuse. Abuse can be verbal as well as physical.
If domestic violence is causing you to feel scared, alone or distressed, then contact one of our family law team for a free no obligation consultation. We are here to help and protect you and your children.
Legal Action
Our first step would be to remove you from the situation. We can help you by contacting the police, or seeking a refuge that provides specific protection to victims of domestic abuse.
If necessary we can seek an order from the court to protect you and your children from the domestic abuse that you are experiencing. The court can grant an injunction on the same day an application has been made if it is urgent. This will be done without advance warning to your partner, the priority will be to keep you and your children safe.
A non molestation order can be issued which prohibits your partner from using or threatening violence against you or your children. They will not be allowed to intimidate, harass or badger you if issued with this order.
When an occupation order is issued, your partner or spouse will be required to immediately vacate the family home. This order suspends their right to occupy the home and can also exclude them from a defined area surrounding your home.
